These Terms of Use ("Terms") govern your access to and use of the playvolley.net platform ("Platform"), a web-based service that enables users to find volleyball teams, apply to tryouts, host and register for events, and connect with playing partners in Berlin, Germany.
The Platform is operated by playvolley.net ("we", "us", or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
To use the Platform, you must create an account by providing a valid email address and password. Authentication is handled through our identity provider (Supabase Auth). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration and to update your profile information as necessary. This includes your name, email address, location, volleyball preferences, and team memberships. You must not create accounts under false identities or on behalf of another person without their consent.
You must be at least 16 years of age to create an account. If you are between 16 and 18 years of age, you represent that you have obtained the consent of a parent or legal guardian to use the Platform.
You must notify us immediately if you become aware of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account where you have failed to safeguard your credentials.
You agree to use the Platform in accordance with these Terms and all applicable laws. In particular, you must not:
Team administrators and coaches are additionally responsible for ensuring that team profiles, tryout listings, and event descriptions they publish are accurate and do not mislead other users.
You retain ownership of any content you submit to the Platform, including profile information, messages, team descriptions, event listings, and partner search posts ("User Content").
By submitting User Content, you grant playvolley.net a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating, maintaining, and improving the Platform. This license terminates when you delete the relevant content or your account, except where the content has been shared with other users or is reasonably necessary for Platform operations (e.g., message history in conversations with other users).
You represent and warrant that you have the right to submit any User Content you provide and that such content does not infringe the intellectual property rights or other rights of any third party.
All other elements of the Platform, including its design, code, logos, and documentation, are the property of playvolley.net and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
To provide our services, we collect and process certain personal data, including your name, email address, location (city, postal code), volleyball preferences (playing category, position, skill level), and team memberships. Your data is stored securely using Supabase infrastructure.
Our collection and processing of personal data is governed by the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG). For full details on how we collect, use, and protect your data, please refer to our Privacy Policy.
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, playvolley.net makes no warranties, express or implied, regarding the Platform's availability, reliability, accuracy, or fitness for a particular purpose.
playvolley.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. This includes, without limitation, damages for loss of data, loss of profits, or business interruption.
In accordance with German law (sections 521 et seq. BGB for gratuitous services), our liability for free services is limited to damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit). Liability for slight negligence (einfache Fahrlässigkeit) is excluded except in cases involving injury to life, body, or health, or the breach of a material contractual obligation (wesentliche Vertragspflicht), in which case liability is limited to foreseeable, typically occurring damages.
playvolley.net is not responsible for the conduct of users, the accuracy of user-generated content, or the outcome of any interactions arranged through the Platform, including tryouts, events, or partner connections. Users participate in volleyball activities at their own risk.
You may delete your account at any time. Upon deletion, your profile data and personal information will be removed from the Platform. Certain data may be retained where required by law or where necessary to maintain the integrity of existing records (for example, records of past team memberships or event registrations may be anonymized rather than deleted).
We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behavior, or if your continued use of the Platform poses a risk to other users or to the Platform itself.
Upon termination, your right to access and use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect, including provisions related to content licenses, limitation of liability, and governing law.
We may update these Terms from time to time. If we make material changes, we will notify registered users by email or by displaying a prominent notice on the Platform. Your continued use of the Platform after such notification constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Platform and delete your account.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of laws provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
For consumers residing in the European Union, mandatory consumer protection provisions of the member state in which the consumer is habitually resident shall apply to the extent that they provide a higher level of protection.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory statutory provisions require otherwise. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) pursuant to the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz, VSBG).
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
